Screwed up, big time

According to the Los Angeles Times, Obama decided to appoint Hillary Clinton as Secretary of State. Rico says he understands the political reasoning behind that. What he doesn't understand, however, is how they're going to get around Article One, Section Six of the Constitution that clearly states:
"No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office."
It specifically prohibits senators (or representatives) from taking a civil office if the legislator has voted to increase the pay for that job. Rico says Hillary will probably try and argue that she was elected, rather than he, but no one's going to buy that distinction...
