One less trial to pay for

Fox 29 has the story:
Philadelphia police confirm Anthony Birch, who opened fire inside a Kmart yesterday, has killed himself as a SWAT team knocked on his door on Wednesday morning. Birch died from a self-inflicted gunshot to the head at his residence on Albanus Street. A SWAT team had just arrived at the house when a guhshot was heard.
Birch, 30, allegedly opened fire with a semi-automatic handgun in the direction of his ex-girlfriend on Tuesday. The gunfire struck a Kmart manager who tried to come to the woman's rescue. Asked what was going through her mind at the time of the shooting, a frightened Kmart customer said, "I was going to get killed. I heard shots fired, and everybody said, 'shots,' and I ran out," the female shopper said. When the gunfire ended, a 35-year-old store manager trying to protect one of his employees was shot. Police said he suffered graze wounds to the head, one to the arm and another to his chest. He was rushed to a nearby hospital and listed Tuesday night in stable condition.
Police said Birch came to the store and started a fight with his ex-girlfriend, who works there. He threatened her and opened fire. She was not injured. "There were several people inside the store. People ran outside. There were several employees inside the store, especially in this area. There's actually video. The detectives are going over it," Philadelphia police Lieutenant Frank Vanore said.
After Birch made his escape, several schools were in lock down as police searched the area. At one point, officers called in the SWAT team to check out a public housing site, but they said Birch was not there. "They believe that he operates a Nissan, gold in color with a black door. So, if someone would see a vehicle like that or may know what happened in here or know this individual, we urge them to call 911 and use caution," Vanore said. Police said the female employee had a history of problems with Birch, the father of her two children. She had a protection-from-abuse order against him at the time of the shooting.
Most Kmart employees were too shaken to talk. One employee said the wounded manager recently hired him. "I'm shocked to hear that it happened here," one man said. "He'd help any of us in there. He's a great guy. I'm really shocked to hear this happened." The store reopened Tuesday night.
Birch is described as 5' 10", wearing a black hat, and a black hooded sweatshirt. He was last seen leaving the store and crossing Frankford Avenue into a neighborhood across the street.
