Just shoot the bastards and have done with it

Seems the whiners are trying to get the Supreme Court to rule that the detainees in Guantanamo are subject to habeas corpus after all..
This, in spite of the fact that the Constitution clearly states that habeas corpus "shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it".
Now, I'm no constitutional scholar (as Sam Ervin, that gentleman from North Carolina, put it so quaintly during the Watergate hearings), but if what these guys have been up to doesn't constitute "rebellion or invasion", then I don't know what they're doing.

"The detainees now enjoy greater procedural protections and statutory rights to challenge their wartime detentions than any other captured enemy combatants in the history of war," according to Solicitor General Paul Clement, who's paid to know.

Drumhead courts-martial, sentencing, and summary execution. That'll do. (Dawn is traditional, but anytime that doesn't disturb the neighbors will be fine.)
